1.   About MY BACKROADS

MY BACKROADS is Backroads’ online Guest Service and Communication portal.

2.   INFORMATION COLLECTION AND USE BY BACKROADS

Like many web sites, we use a tracking utility that uses log files to track users' movements in the aggregate. Information collected includes internet protocol (IP) addresses, browser type, internet service provider (ISP), referring/exit pages, platform type, and date/time stamp. None of this information is linked to any personally identifiable information. We collect this information to help us administer the site and provide better services to users.

If you register to become a MY BACKROADS member, you will be required to provide a username, password, and an email address. Your password is not visible to anyone, including site administrators. It is saved in a database in an encrypted form. While offering some security, it is always possible that this database could be compromised by malicious users. You are urged, therefore, to use a password that would not give someone access to any of your other Internet uses.

Your email address is used to provide certain automatic notifications related to use of the Service. Your email address may also be used to notify you of important administrative matters, such as pending termination of membership for inactivity or site downtime. You may not opt-out of such mailings, but we expect that they will be very infrequent. Your email address may also be used to send you our e-newsletter, if you elect to receive it when you register or any time thereafter.

Your email address may also be provided to companies which provide services such as information processing, fulfilling guest orders, providing pre-/post- and on-trip services, managing and enhancing customer data and conducting customer research or satisfaction surveys. These companies are obligated to protect your information.

Your email address will not be sold to third parties.

3.   USE OF COOKIES

If you use our Service, a persistent cookie may be placed on your computer, unless you have cookies disabled in your browser. You may still use our Service if you reject this cookie. Usage of cookies is not linked to any personally identifiable information. (A cookie is a piece of data stored on the user’s computer tied to information about the user.) Persistent cookies can be removed by following Help directions of your web browser.

4.   CORRECTING/UPDATING OR REMOVING INFORMATION

If you register as a MY BACKROADS member, you may change any of the information provided when you register, except your Login ID and screen name, by logging into your account and editing your profile and options.  You may request that your Login ID be changed for good reason by contacting us. You may not terminate your own membership, but it will be terminated upon your request.  Click on the Contact link at the bottom of any Backroads webpage for information on how to contact us.

5.   OPT-OUT

Members may not opt out of receiving service announcements and administrative messages. Members who do not wish to receive the Backroads e-newsletter may choose not to by deselecting “Monthly E-Mail Newsletter” in the user profile 'Account Settings'.  All Backroads e-newsletters also include the above instructions for opting-out of those communications in the future.

6.   SECURITY

MY BACKROADS member accounts are secured by member-created passwords. Backroads takes precautions to insure that member account information is kept private.  We use reasonable measures to protect member information that is stored within our database, and we restrict access to member information to those employees who need access to perform their job functions, such as our customer service personnel and technical staff.  Please note that we cannot guarantee the security of member account information.  Unauthorized entry or use, hardware or software failure, and other factors may compromise the security of member information at any time. For any additional information about the security measures we use on MY BACKROADS, please contact us at Backtalk@backroads.com.

7.   SHARING AND DISCLOSURE OF INFORMATION BACKROADS COLLECTS

Except as otherwise described in this privacy statement, Backroads will not disclose personal information to any third party unless we believe that disclosure is necessary: (1) to conform to legal requirements or to respond to a subpoena, search warrant or other legal process received by Backroads, whether or not a response is required by applicable law; (2) to enforce the Backroads Terms of Service Agreement or to protect our rights; or (3) to protect the safety of members of the public and users of the service. Backroads reserves the right to transfer personal information to a successor in interest that acquires rights to that information as a result of the sale of Backroads or substantially all of its assets to that successor in interest. For more information see the "Changes in Our Privacy Policy" section below.

8.   CHANGES IN OUR PRIVACY POLICY
